TLDR
I have a good firearms lawyer here in GA that is interested in helping me to file suit with the ATF over Form 1 wait times. Should I try it?
Background
I am a CCW holder in my state.
I have a stamped SBR from back when you could efile with a trust.
I have just submitted another Form 1 with all the new paperwork for a new SBR (trust, fingerprint cards, picture, notified CLEO, etc.).
Credit card was already hit for the $200.00 this Dec, 2017.
I am not interested in just rushing my own stamp along. Instead I am looking to help force approval times back to something bordering on reasonable (ie. 2-3 months).
I did try to search for 'sue' and 'suit' before posting this and didn't see anything.
Legal Stuff
Lawyer says it would be at least $5000.00 and that is if things resolve quickly (they won't). I would probably do a GoFundMe or something to raise money for the suit.
I believe we have a case since ATF has taken the $200.00 already and my understanding is current wait times are approx 360 days. I would say this is excessive and onerous and other legal terms for 'give me my stamp.' Since a NICS check happens in minutes it seems unreasonable that Form 1 approval would border on a 1 year wait.
I have not paid my lawyer a penny yet so the formal legal argument is not fashioned but it seems that he feels a solid one can be made.
Questions
Is this even a good idea?
Is this something a community like this would want to even see happen?
What negative impacts could this have to the Form 1 process as it now stands?
Does anyone really know why processing times are so long?
